Nuvex Outreach – Terms & Conditions
1. Introduction
These Terms & Conditions govern the use of Nuvex Outreach services, website, campaigns, free trials, retainers and related outreach activities.
By accessing our website, submitting forms, requesting services, accepting quotations or using Nuvex Outreach services, you acknowledge and agree to these Terms & Conditions.
2. About Nuvex Outreach
Nuvex Outreach provides candidate sourcing and outreach services designed to help businesses and recruitment teams engage potential candidates through targeted outreach systems and campaign automation.
Nuvex Outreach is not a recruitment agency and does not:
• guarantee hires
• guarantee placements
• conduct interviews
• provide recruitment management software
• act as an employer or employment intermediary
3. Scope of Services
Services may include:
• Candidate sourcing
• Recruitment outreach campaigns
• Candidate engagement tracking
• Campaign reporting
• Recruitment automation support
• White-label outreach services
• Candidate form and response tracking
Service offerings may vary depending on package selection, campaign scope and operational requirements.
4. Free Trial Terms
Nuvex Outreach may offer a once-off free trial campaign to qualifying businesses or agencies.
Free trial campaigns:
• are limited to one per company or retainer relationship
• are non-transferable
• remain subject to approval by Nuvex Outreach
Nuvex Outreach reserves the right to refuse free trial requests where:
• services are not deemed a suitable fit
• illegal or unethical activity is suspected
• misuse or abuse of services may occur
Free trial campaigns do not reset if:
• a retainer is cancelled and restarted
• the client upgrades services
• the client changes packages or service levels
5. Pricing & Payment Terms
Pricing information is available at:

Retainers
• Retainers are payable in advance
• Retainers automatically renew monthly unless cancelled with 30 days written notice
• Retainer fees are non-refundable
Unused funnel or outreach allocations may roll over to the following month only, after which unused allocations expire.
Campaign Payments
Clients agree to pay invoices on or before the due date communicated through the Nuvex Outreach invoicing system.
Nuvex Outreach reserves the right to:
• pause campaigns
• suspend services
• withhold deliverables
• terminate active outreach
where payments remain outstanding.
Outstanding balances may incur 10% monthly interest.
6. Refund Policy
All payments made to Nuvex Outreach are non-refundable once:
• campaign setup
• sourcing
• outreach preparation
• onboarding
• campaign execution
has commenced.
7. Campaign Approval Process
Campaigns will only commence once:
• onboarding information is completed
• campaign details are confirmed
• required approvals are received
• applicable payments are made
Clients have 48 hours to:
• approve outreach material
• request amendments
• provide written feedback
If no written objection or amendment request is received within 48 hours, campaign material shall be deemed approved and campaigns may proceed.
Delays in client communication may impact delivery timelines.
8. Candidate Data & Reporting
Nuvex Outreach provides outreach reporting that may include:
• candidate names
• candidate email addresses
• email opens
• clicks
• replies
• form submissions
• CV submissions
• engagement summaries
Clients receive responses and submissions directly through the designated campaign communication channels or configured inboxes.
Nuvex Outreach does not sell bulk databases or unrestricted candidate data lists.
9. Performance Disclaimer
Nuvex Outreach provides sourcing and outreach services only.
We do not guarantee:
• hires
• placements
• interviews
• candidate availability
• response rates
• inbox placement
• campaign outcomes
Campaign performance may vary depending on:
• market conditions
• industry demand
• role complexity
• location
• domain health
• candidate responsiveness
• third-party email infrastructure
Final recruitment outcomes remain solely the responsibility of the Client.
10. Client Responsibilities
Clients agree:
• to provide accurate campaign and job information
• to use candidate data lawfully and ethically
• to comply with applicable recruitment and employment laws
• not to misuse or redistribute candidate data
Clients remain solely responsible for:
• interviews
• hiring decisions
• employment offers
• placement processes
11. Data Usage & Confidentiality
All outreach data is sourced from publicly available information and processed for recruitment-related outreach purposes.
Clients may use candidate data internally only and may not:
• resell
• redistribute
• share candidate information with third parties
without consent.
Both parties agree to maintain confidentiality regarding:
• operational information
• campaign information
• candidate information
• business-sensitive information
Nuvex Outreach may use anonymized campaign statistics and performance metrics for marketing purposes.
Client names, logos or branding will only be used with written permission.
12. Intellectual Property
All Nuvex Outreach systems, workflows, automations, outreach copy, funnels, methodologies, campaign structures and operational processes remain the exclusive intellectual property of Nuvex Outreach.
Clients may not:
• copy
• replicate
• reverse engineer
• reproduce
• redistribute
• commercially exploit
any Nuvex Outreach systems or processes without written consent.
13. White-Label Services
Nuvex Outreach may offer white-label outreach or partnership services at its discretion.
Certain partnership arrangements may require separate written approval or operational agreements.
14. Prohibited Use
Nuvex Outreach services may not be used for:
• illegal activity
• fraudulent activity
• spam or malicious communications
• discriminatory hiring practices
• prohibited or unethical business activity
Nuvex Outreach reserves the right to refuse or terminate services immediately where misuse is identified.
15. Limitation of Liability
Nuvex Outreach shall not be liable for:
• indirect losses
• business interruption
• hiring outcomes
• campaign performance fluctuations
• recruitment decisions
• reputational damages
• third-party infrastructure failures
Nuvex Outreach’s maximum liability shall not exceed the total fees paid by the Client for the specific campaign or service giving rise to the claim.
16. Governing Law
These Terms & Conditions shall be governed by the laws of the Republic of South Africa.
International outreach activities shall additionally comply, where reasonably applicable, with relevant international communication and data handling standards.
17. Dispute Resolution
The parties agree to attempt dispute resolution in the following order:
Informal discussions
Mediation
Legal proceedings through the appropriate courts of South Africa
18. Amendments
Nuvex Outreach reserves the right to modify or update these Terms & Conditions at any time.
Updated terms become effective upon publication on the Nuvex Outreach website.

2. Campaigns & Delivery
Campaigns are initiated once all required onboarding information is received
Standard turnaround is 3–5 working days
Rush campaigns (within 48 hours) may incur additional fees
Nuvex reserves the right to determine when sufficient campaign progress has been made.
3. Pricing & Payment
3.1 Setup Fee
A once-off setup fee applies per client
This fee is non-refundable
3.2 Campaign / Retainer Fees
Campaign or monthly fees must be paid as agreed before campaign commencement
Services may be paused if payments are not received
3.3 Performance-Based Pricing
Clients are charged based on engagement levels, including:
Candidates sourced and contacted
Candidate engagement (clicks/replies)
Qualified candidates (form submissions)
Clients may choose how many leads they wish to receive.
3.4 Payment Terms
50% deposit required before campaign start
Balance payable upon completion
Late payments may incur 10% interest per 30 days
4. Client Responsibilities
The client agrees to:
Provide accurate job specifications and requirements
Review and approve campaign materials where required
Use candidate data responsibly and lawfully
5. Candidate Data & Usage
Candidate data is provided solely for recruitment purposes
Data may not be resold, shared, or distributed to third parties
Only the purchasing client may use the data
6. Data Compliance (POPIA)
Nuvex processes data in accordance with POPIA
Candidate data may be sourced from publicly available platforms
By using our services, the client acknowledges and accepts this
7. No Guarantee of Results
Nuvex Outreach does not guarantee:
Candidate placement
Interview outcomes
Hiring success
We provide access to engaged and qualified candidate leads only.
8. Non-Exclusivity
Nuvex may run campaigns for similar roles or industries simultaneously
No exclusivity is granted unless agreed in writing
9. Campaign Usage & Funnels
Clients are allocated a number of active campaign funnels
Funnels may be rotated once campaigns have reasonably progressed
Nuvex retains discretion on campaign completion and rotation timing
10. Intellectual Property
All systems, processes, templates, and methodologies remain the property of Nuvex Outreach.
Clients may not:
Replicate
Reverse-engineer
Distribute
any part of the service.
11. Limitation of Liability
Nuvex’s liability is limited to the value of services rendered
We are not liable for:
Hiring decisions
Loss of business
Indirect or consequential damages
12. Breach & Misuse
If a client:
Shares data unlawfully
Attempts to bypass or misuse the service
They may be held liable for any resulting financial or reputational damages.
13. Termination
Nuvex reserves the right to:
Suspend or terminate services
Withhold delivery
in cases of:
Non-payment
Breach of terms
14. Governing Law
These Terms are governed by the laws of South Africa.
15. Dispute Resolution
In the event of a dispute:
Parties agree to attempt resolution amicably first
If unresolved, legal action may be pursued
16. Amendments
Nuvex reserves the right to update these Terms at any time. Continued use of services constitutes acceptance.
